TERMS AND CONDITIONS FOR THE FUREVER CLUB LOYALTY PROGRAM

General

  1. The FurEver Club is Budget Pet Products' loyalty rewards program, which is offered exclusively to customers in Australia.  
  2. These Terms and Conditions ("Terms") govern the operation of The FurEver Club and apply to Australian residents.  
  3. Participation in The FurEver Club indicates agreement to these Terms, which should be read in conjunction with the Website Terms and Conditions and any applicable laws or regulations.  
  4. By joining The FurEver Club, you agree to be bound by these Terms, the Website Terms and Conditions, and all relevant laws.  
  5. Membership in The FurEver Club also constitutes your consent to receive communications from Budget Pet Products via email, SMS, mail, and push notifications, unless you have opted out, as detailed in our Privacy Policy. 

Eligibility

  1. Membership in The FurEver Club is open only to Australian residents.  
  2. The benefits associated with membership are available exclusively in Australia and apply solely to purchases classified as "Participating Purchases" under these Terms. 

Joining The FurEver Club

  1. Membership in The FurEver Club is free and can be obtained by signing up through the "Join Now" button on the Budget Pet Products website or app.  
  2. Individuals under the age of eighteen (18) must obtain the consent of a parent or guardian to join, and Budget Pet Products assumes compliance with this requirement if an account is created for a minor.  
  3. There are no fees associated with joining or maintaining membership in The FurEver Club; however, in order to earn rewards, gifts, benefits, or offers (collectively referred to as "Benefits"), members must make purchases of products from Budget Pet Products platforms 

Membership Benefits

  1. Members of The FurEver Club are entitled to access a variety of rewards, gifts, offers, and benefits, collectively referred to as "Benefits."  
  2. The specific Benefits available may vary depending on the member’s membership level and are subject to periodic updates.  
  3. Details regarding the Benefits can be found on The FurEver Club webpage and in the frequently asked questions section on the Budget Pet Products website.  
  4. Members are encouraged to regularly review these resources to remain informed of the Benefits available to them.  
  5. Budget Pet Products will provide at least thirty (30) days' notice of any changes to Benefits to allow members an opportunity to redeem existing offers before the changes take effect. 

Membership Levels

  1. Membership in The FurEver Club is divided into two levels: Green Membership and Gold Membership (each referred to as a "Membership Level").  
  2. A member’s level is determined by the amount of "Participating Purchases" made annually.  
    • Green Membership: $0 - 549.99 Annual Spend
    • Gold Membership: $550+ Annual Spend
  3. Participating Purchases are defined as purchases of products or services made through the Budget Pet Products Online Store in accordance with these Terms.  
  4. The Online Store includes both the website at www.budgetpetproducts.com.au and the Budget Pet Products app.  
  5. Only purchases made by the member personally count towards determining membership level; purchases made by others cannot be attributed to the member’s account.  

Participating Brands

  1. Points are earned only on purchases of products from brands designated as "Participating Brands" by Budget Pet Products.  
  2. A list of Participating Brands is available on The FurEver Club webpage.  
  3. Budget Pet Products reserves the right to modify the list of Participating Brands at any time, provided that changes are communicated to members with at least thirty (30) days' notice.  
  4. Products from non-Participating Brands do not earn points, even if purchased through the Budget Pet Products website or app. 

Membership Spend Calculation

  1. Membership spend is calculated on a calendar-year basis, beginning on January 1 and ending on December 31 of each year and includes GST. 
  2. Purchases made through the Budget Pet Products website, app, or auto-delivery services are counted towards membership spend on the date payment is made for the order. 
  3. All products purchased from the Budget Pet Products online store with the exception of Discounts, donations, delivery charges, refunds, and returns are included in the calculation of annual spend.  
  4. If a member receives a refund or reimbursement for a purchase, the refunded or reimbursed amount will be deducted from their membership spend.  
  5. Membership upgrades take effect immediately upon meeting the required spend, while downgrades occur annually after a review of the members spend. 

Earning Points

  1. Points are earned for each dollar spent on Participating Brands, with the rate of accrual depending on the member’s Membership Level.
    • Green Membership: 1 Point Earned per $1 Spent
    • Gold Membership: 2 Points Earned per $1 Spent
  2. Points are calculated on the purchase price, including GST, and the cart total is then rounded up to the nearest dollar.  
  3. Points are personal to the member, non-transferable, and cannot be redeemed for cash.  
  4. Points expire three (3) years after they are earned unless the membership is terminated prior to this date.  
  5. When a member’s level changes, the new rate of point accrual applies from the date of the change, but existing point balances are not recalculated. 

Returns, Refunds, and Points Adjustments

  1. If a member receives a refund for a purchase, the points earned for that purchase will be reversed.  
  2. If points have been redeemed prior to the refund being processed, the member’s account may reflect a negative point balance.  
  3. For partial refunds, the points associated with the refunded portion will be adjusted proportionally. For example, if $50 worth of goods was purchased using $10 in Loyalty Points and $40 in cash, and the goods are refunded, $40 will be refunded via the original payment method, and $10 will be reissued as Loyalty Points, valid for four (4) weeks from the date of reissue. 

Redeeming Points and Benefits

  1. Members may choose either;
    • a $10 discount, OR
    • product/s per unique transaction. 
  2. Members may redeem a maximum of one (1) $10 discount per unique transaction by converting earned points. 
  3. Each product presented in the Members Points Store has a maximum redemption of one (1) per unique item in each transaction.   
  4. The maximum number of products that can be redeemed from the Members Points Store per transaction is limited to 10. 
  5. Unless otherwise specified, each benefit may be redeemed only once.  
  6. Benefits cannot be redeemed for cash or transferred. 
  7. Where a member redeems a product using points, these products will not earn the member FurEver points. 

Account Maintenance

  1. Members are responsible for maintaining the confidentiality of their account details, including usernames and passwords, and for restricting third-party access to their account.  
  2. Members must ensure that all account information is accurate, current, and complete.  
  3. Members are also responsible for all activities that occur under their account. 

Communication Preferences

  1. Members may update their account details or communication preferences by logging into their account on the Budget Pet Products website or by contacting Customer Care.  
  2. To opt out of promotional communications, members may use the unsubscribe link in emails, reply "STOP" to SMS messages, or contact Customer Care directly.  
  3. Budget Pet Products is not responsible for any missed Benefits or changes in membership status resulting from inaccurate account details or communication preferences. 

Termination of Membership

  1. Budget Pet Products reserves the right to terminate a member’s account without notice if it reasonably believes that the member has breached these Terms.  
  2. Upon termination, members forfeit any accrued Benefits and membership spend. 

Changes to These Terms

  1. Budget Pet Products may update these Terms as necessary and will make the updated version available on its website.  
  2. Members are encouraged to review the Terms regularly.  
  3. Continued participation in The FurEver Club after changes are made constitutes acceptance of the updated Terms.  

Governing Law

  1. These Terms are governed by the laws of Queensland, Australia.  
  2. Members agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction in Queensland, Australia.

No Waiver and Severability

  1. Failure by Budget Pet Products to enforce any of its rights under these Terms does not constitute a waiver of those rights.  
  2. If any provision of these Terms is found to be illegal, void, or unenforceable, that provision will be severed, and the remainder of the Terms will continue in full force and effect.
